4. Medicare Disclaimer
Compass Consultants LLC is not affiliated with, endorsed by, or acting on behalf of the federal government or the Centers for Medicare & Medicaid Services (CMS).
We do not offer every plan available in your area. Currently, we represent a number of organizations which offer a variety of products in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program (SHIP) to get information on all of your options.
5. Scope of Appointment (Medicare)
For Medicare-related consultations:

A Scope of Appointment (SOA) may be required prior to discussing plan options

Discussions will be limited to the topics agreed upon in advance

20. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms & Conditions or the services provided by Compass Consultants LLC shall be resolved through binding arbitration, rather than in court, except where prohibited by law.
Arbitration shall be administered by a mutually agreed-upon arbitration provider and conducted in accordance with its applicable rules.
The arbitration shall take place in Allegheny County, Pennsylvania, and judgment on the arbitration award may be entered in any court having jurisdiction.
Each party shall bear its own legal fees and costs unless otherwise required by applicable law or determined by the arbitrator.
By agreeing to these Terms, you waive your right to a trial by jury and to participate in a class action lawsuit.
21. Limitation of Damages
To the fullest extent permitted by law, Compass Consultants LLC’s total liability for any claims arising out of or related to the use of our services shall be limited to the greater of:

The amount paid (if any) by you for services provided by Compass Consultants LLC within the twelve (12) months preceding the event giving rise to the claim, or

Under no circumstances shall Compass Consultants LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or loss of business opportunities.
22. Jurisdiction & Venue
To the extent that any dispute is not subject to arbitration, you agree that such dispute shall be resolved exclusively in the state or federal courts located in Allegheny County, Pennsylvania.
You consent to the personal jurisdiction of such courts and waive any objections to venue or inconvenient forum.
23. Electronic Communications & Signatures
By engaging with Compass Consultants LLC, including through our website, forms, email, or text messaging, you consent to the use of electronic communications and electronic signatures.
You agree that electronic agreements, disclosures, and signatures have the same legal effect as physical, written documents and handwritten signatures.
You further agree that records of your electronic consent, including timestamps, IP addresses, and communication logs, may be maintained by Compass Consultants LLC and used as evidence of your agreement where permitted by law.
24. Record Retention
Compass Consultants LLC maintains records of client interactions, communications, and transactions in accordance with applicable legal, regulatory, and business requirements.
